A request for an expiry review must be submitted no later than 3 months before the date of expiry of the measures in force.

An expiry review can result only in the repeal or continuation of the duties in force.

Interested parties may ask for an interim review of the measures during their period of imposition (normally 5 years), once the measures have been in force for 1 year.

A request for an interim review must be sent to the Office of Complaints in DG Trade, stating the reasons for the review and providing sufficient evidence of the need for a review.

An interim review can result in measures being amended, repealed or continued.

Imports from companies that cooperated in the original investigation are usually liable to their own individual duty, but there is also a ‘country-wide’ duty for imports from all other companies producing and exporting the product concerned.

To qualify as a ‘new exporter’, a company must fulfil these three criteria.

In all proceedings, the Commission is under an obligation to uphold the rights of defence of all parties.
