On 23 December 1997, Brazil requested consultations with Peru in respect of a countervailing duty investigation being carried out by Peru against imports of buses from Brazil. Brazil contended that the procedures followed by the Peruvian authorities to initiate this investigation are inconsistent with Articles 11 and 13.1 of the Subsidies Agreement.
