Malaysia Stop Dumping Investigation PET Indonesia

Ministry of International Trade and Industry of Malaysia to stop repeated allegations of dumping investigations against products of polyethylene terephthalate, Indonesia. Polyethylene terephthalate (PET)-which, among other materials used in the manufacture of synthetic fibers and where food and beverages-from Indonesia and the country facing similar charges were Chinese Taipei and Korea.

According to a press release the Ministry of Commerce on Tuesday (05/17/2011), the final decision related to the investigation of dumping allegations re-issued by the Ministry of International Trade and Industry of Malaysia on 20 April 2011.
Malaysia to stop the investigation because authorities found no evidence of dumping on exports of PET products from Indonesia, China, and Korea. They also found no Malaysian domestic industry losses due to the entry of these products. Thus, subsequent PET products from third countries will be excluded from the imposition of anti-dumping duty (BMAD), so it will be more competitive in the Malaysian market.
Ministry of International Trade and Industry Malaysia started back anti-dumping investigations against products from Indonesia PET on January 27, 2005.

Investigations carried out on several Indonesian companies, namely PT Bakrie / Kasei Corporation, PT Indorama Synthetics Tbk, PT Petnesia Resindo, PT Polypet Karyapersada, and PT SK Keris.

In the decision (final measure) issued the Ministry of International Trade and Industry of Malaysia on October 23, 2005, exporters of PET Indonesia are subject to BMAD at 0 percent to 17.69 percent for five years.

October 14, 2010, the Ministry of International Trade and Industry Malaysia initiate an investigation back to the imposition of BMAD that the validity period will end on October 22, 2010.

Government of Indonesia, in this case the Security Directorate of Trade Ministry of Commerce, has submitted information to the defendant company and asked them to cooperate.

Ministry of Trade also sent a representative to accompany the defendant company during the verification process by the Ministry of International Trade and Industry of Malaysia on 29 December 2010-5 January 2011. In addition to mentoring, the government also submitted a response to “Notice of Essential Fact” with the issue of standing of petitioner who do not qualify and no evidence of loss suffered by the domestic industry of Malaysia.

Indonesia is one of the main exporters of PET products to Malaysia. Based on data Trademap, in 2010 Malaysia was the fourth state of Indonesia’s export destination for PET products with a value of 11 million U.S. dollars. Termination of the imposition of BMAD by Malaysian authorities are expected to increase market share in Malaysia, Indonesia PET products.
