In preparing its defence of the final injury investigation, the foreign company must consider a number of issues. Some of these issues relate to issues already considered during the preliminary injury investigation.

During the course of an anti-dumping or countervailing duty investigation, many companies ask whether there is some way the case can be settled. Usually, the answer is no.

For other trade remedies the rules are less formal. There is no equivalent of a 'suspension agreement' for a Section 201 safeguards case.

After the preliminary determination, the Commerce Department conducts a `verification' of the response to the questionnaire

Whenever possible, the Commerce Department compares identical merchandise in the United States market and comparison markets.

Injury determinations: Condition of the domestic industry

The cost information can be used in two ways. First, the Commerce Department uses the cost information to determine whether foreign market prices are above the cost of producing the merchandise.
