Hardwood plywood – The U.S investigates Anti-Circumvention measures

On June 10, 2020, the US Department of Commerce (DOC) initiated the investigation of Anti-Circumvention measures on Hardwood Plywood completed in Vietnam.


I. Relevant information:

2. Petitioner: Coalition for Fair Trade in Hardwood Plywood


3. Goods under investigation:  Hardwood plywood, primarily under the subheadings: 4412

 

4. Preliminary conclusion:

 

On July 25, 2022, the US Department of Commerce (DOC) announced the preliminary conclusion of the investigation into evasion of trade defense measures on hardwood plywood imported from Vietnam. .

 

DOC's preliminary conclusion is that Hardwood Plywood from Vietnam, if it has a core using veneer imported from China, will be subject to anti-dumping and CTC taxes as currently applied to Hardwood Plywood imported from China. Hardwood Plywood from Vietnam, if it has a core using veneer produced in Vietnam or other countries, is not subject to anti-dumping and CTC taxes.

 

Based on this preliminary conclusion, DOC will request the US Customs and Border Protection (CBP) to continue to stop liquidity and require importers to pay a deposit equal to the provisional anti-evasion tax rate for with shipments imported from Vietnam to the United States since June 17, 2020 (the date of notification of initiation of investigation) for cases subject to the measures.

 

DOC allows Vietnamese exporters as well as U.S. importers to participate in the self-certification mechanism to be excluded from circumvention.

 

5. Final conclusion

 

On July 20, 2023, USDOC issued a final conclusion confirming that there was an act of evasion of anti-dumping and CTC taxes that the United States is applying to China. Decision to impose tax:

 

- Anti-dumping tax rate: 183.36%

 

- CTC tax rate: 22.98%
