Canada starts re investigation on subsidy on Chinese seamless steel casing pipes and OCTG

The Canada Border Services Agency has initiated a re investigation to update amounts of subsidy, pursuant to the Special Import Measures Act as part of the ongoing enforcement of the Canadian International Trade Tribunal findings respecting:

  1. Certain seamless carbon or alloy steel oil and gas well casing originating in or exported from the People's Republic of China (China) issued on March 10th 2008 in Inquiry No. NQ-2007-001
  2. Certain oil country tubular goods originating in or exported from China issued on March 23rd 2010 in Inquiry No NQ-2009-004.

The CBSA is not initiating a re investigation of normal values respecting these two cases at this time.

It is anticipated that this re-investigation will be concluded on or before November 7th 2011.

The amounts of subsidy established during this re investigation will be effective for subject goods released from the CBSA on or after November 7, 2011, or the date of the ruling letter to the exporters, whichever occurs first. Also, at that time, the amounts of subsidy currently in place will expire. Importers are cautioned that new amounts of subsidy, when issued, may be higher than those currently in effect and that this could result in additional assessments of countervailing duty.

The amounts of subsidy determined as a result of the re-investigation will be applied to any requests for re-determination of importations of subject goods that are received on or after June 9th 2011 (the initiation date of this re investigation). In addition, the amounts of subsidy will be applied to any requests for re-determination of importations of subject goods that have not been processed prior to the conclusion of this re-investigation, regardless of the date that the requests were received, where these amounts of subsidy are applicable.

As part of this re investigation, the CBSA will be contacting the Government of China to obtain information on subsidy programs available to manufacturers and/or exporters of the subject goods located in China.
