Anti-dumping: EP adopts modification of Council regulation

MEPs adopted at first reading the European Commission’s proposal, on 10 May, to amend a Council regulation regarding the protection against dumped imports from countries not members of the European Community.
Article 9 of Council Regulation (EC) 1225/2009 was found inconsistent with the World Trade Organisation’s anti-dumping agreement (Articles 6.10, 9.2 and 18.4) as well as the WTO agreement (Article XVI:4). In July 2011, the WTO’s Dispute Settlement Body, found, in the case ‘European Communities – Definitive anti-dumping measures on certain iron or steel fasteners from China’, that the EU’s regulation was inconsistent.
