US: DOC Issues Final AD and CVD Determinations on Imported Mattresses; ITC Will Complete Its Final Injury Investigation

The US Department of Commerce (DOC) today released its final determinations in the antidumping duty (AD) investigations of mattresses imported from Cambodia, Indonesia, Malaysia, Serbia, Thailand, Turkey and Vietnam and the countervailing duty (CVD) investigation of mattresses imported from China. The final AD margins range from 2.22 to 763.28%, depending on the country and the producer or exporter from a given country. The country-specific AD margins are as follows:

DOC’s AD and CVD rates will go into effect once these final determinations are published in the Federal Register, which is expected to occur within approximately 5-7 business days from today. At that time, US Customs and Border Protection will continue the suspension of liquidation that occurred when DOC issued its preliminary AD determinations last October and will change the cash deposit requirements to reflect the above rates.

By way of background, these investigations commenced after seven US mattress manufacturers and two unions representing workers at US mattress plants filed AD and CVD petitions with both DOC and the US International Trade Commission (USITC) on March 31, 2020 alleging that imports of mattresses from the above countries were being sold in the United States at unfair and subsidized prices and were causing material injury to the US mattress industry.

DOC formally initiated its investigations on April 24, 2020, and the USITC announced the results of its preliminary affirmative injury determinations in these cases on May 14, 2020. On September 11, 2020, DOC found China was providing unfair subsidies to its mattress producers and imposed countervailing duties of 97.78% to offset those subsidies. On October 28, 2020, DOC issued preliminary affirmative AD findings.

With these final DCO AD and CVD findings, the USITC will now complete its investigation of whether these unfairly traded imports are causing material injury to the US industry. The USITC held a hearing in its final investigation yesterday. The USITC is expected to hold its public vote in this case on or around April 21, 2021, and to issue its formal written decision soon after that.
