On May 01, 2017, the Department of Commerce of the United States issued a notification to initiate an anti-dumping duty investigation against tool chests and cabinets imported from Vietnam and China (additionally, DOC launched a countervailing duty investigation imported from China).

I. Relevant information:

1. Initiated date: May 01, 2017

2. Scope of investigation: Tool chests and cabinets under the HS Code: 9403.20.0030, 9403.20.0026 and 7326.90.3500.

3. Investigation period: From October 01, 2016 to March 31, 2017.

4. Petitioner: Waterloo Industries, Inc. (MO).

5. Preliminary conclusion

On November 7, 2017, DOC preliminary concluded that tool cabinets imported from Vietnam showed signs of dumping.

 

6. Final conclusion

On April 3, 2018, DOC officially concluded that tool cabinets imported from Vietnam showed signs of dumping. Then, on May 29, 2018, DOC issued an anti-dumping duty order with the tax rate on the above goods imported from Vietnam being 327.17% (equal to the dumping margin).

 

7. Sunset review

On November 23, 2022, the DOC announced that it would conduct a period-end review of the anti-dumping tax order for tool cabinets imported from Vietnam.

 

On March 8, 2023, the DOC issued the results of the end-of-term review, confirming that the above imported goods from Vietnam will continue to cause dumping if the tax order is removed.

 

On July 12, 2023, DOC issued a decision to continue to impose an anti-dumping tax on tool cabinets imported from Vietnam with the same tax rate.
