Malaysia imposes provisional anti-dumping duty

PETALING JAYA (Dec 21, 2012): The government has found sufficient evidence to continue with further investigation on the imports of biaxially oriented polypropylene (BOPP) from alleged countries, following preliminary investigations on dumping of the material -- normally used in high quality packaging -- here.

The final determination will be made based on the outcome of the verification visits to foreign producers' premises no later than 120 days from the date of the notice of the preliminary determination report.

The preliminary investigations were carried out as provided under Section 23 of the Countervailing and Anti-Dumping Duties Act 1993.

The Ministry of International Trade and Industry said the government has decided to impose a provisional measure in the form of provisional anti-dumping duty guaranteed by a security equal to the amount of the dumping margin determined through the preliminary investigation.

"Provisional anti-dumping duties ranging from 6.87% to 21.43% will be applied on imports from the alleged countries and shall be effective not more than 120 days from the date of the Government Gazette," it said in a statement today.

The government had initiated an anti-dumping investigation on July 27, based on a petition filed by San Miguel Yamamura Plastic Films SdnBhd on behalf of the domestic industry producing BOPP.

The petitioner alleged that imports of BOPP originating in or exported from Taiwan, Thailand, China, Indonesia and Vietnam are being imported into Malaysia at a price much lower than the price in the domestic market of the alleged countries, causing material injury to the industry here.
