Consultations

Complaint by China.

On 5 November 2012, China requested consultations with the European Union, Greece and Italy regarding certain measures, including domestic content restrictions, that affect the renewable energy generation sector relating to the feed-in tariff programs of EU member States, including but not limited to Italy and Greece.

China claims that these measures are inconsistent with:

  • Articles I, III:1, III:4 and III:5 of the GATT 1994;
  • Articles 3.1(b) and 3.2 of the SCM Agreement; and 
  • Articles 2.1 and 2.2 of the TRIMs Agreement

On 16 November 2012, Japan requested to join the consultations.  On 19 November 2012, Australia and Argentina requested to join the consultations. Subsequently, the European Union informed the DSB that it had accepted the request of Japan to join the consultations.
