Antidumping decisions and regulatory captured in Europe and United States

Abstract:
This paper examines the determinants of antidumping decisions administered by the International Trade Commission (ITC) in the United States (US) and the European Commission in Europe (EU). Based on the Gasmi, Hansen, Laffont’s Model, we investigate this issue in greater depth. Our analysis of antidumping regulation recognizes the asymmetry of information, which exists in the regulatory process, and the substantial discretionary power of the authorities. We showed that the ITC and the EU’s decision-making are significantly influenced by both economic and political factors. These regulatory agencies are therefore captured through some ‘direct’ channel, reflecting a direct influence of domestic firms on the regulator’s decision to impose dumping remedies.
