Decision No. 1347/QD-BCT on May 19, 2020 implementing a number of activities of the Ministry of Industry and Trade to improve trade remedies capacity

The Ministry of Industry and Trade has just issued Decision No. 1347/QD-BCT on May 19, 2020, implementing a number of activities of the Ministry of Industry and Trade to improve trade remedies capacity for domestic manufacturing industries in the context of Vietnam's participation in new-generation free trade agreements (FTAs).

Accordingly, the Ministry of Industry and Trade will deploy the following four key groups of activities: Pursuant to Decree No. 98/2017/ND-CP of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade. Mercy; Resolution No. 06-NQ/TW on November 1, 2016 of the Fourth Conference of the 12th Party Central Committee on effective implementation of the international economic integration process, maintaining political stability, society in the context of Vietnam's participation in new generation FTAs; At the request of the Director of the Trade Remedies Department, the Minister of Industry and Trade Tran Tuan Anh made a decision to implement activities to improve the capacity of trade remedies for domestic manufacturing industries in the context of Vietnam's participation in new generation FTAs.

Firstly, training on trade remedies for domestic industries, through the organization of seminars and training programs on the use of trade remedies for associations, businesses, and industry members; training courses on anti-evading trade remedies for goods imported into Vietnam; Disseminating and guiding the use of the System for early warning of anti-dumping cases and identifying the risk of being investigated for foreign trade remedies; organizing training courses on trade remedies for departments, branches and localities in order to improve coordination ability to handle trade remedy lawsuits and protect domestic production; at the same time, organizing a training program on trade remedies for the communication team of the Ministry of Industry and Trade…

Secondly, providing information on trade remedies to domestic associations and industries. In particular, focusing on drafting and disseminating manuals for businesses to use and respond to trade remedies in a number of industries such as steel, furniture, fisheries, chemicals, textiles and Auxiliary industry.; building a column on trade remedies for manufacturing industries in the Industry and Trade Newspaper, the Electronic Industry and Trade magazine; deploying newsletters on trade remedies and early warning; building an electronic portal providing information and results on early warning in the field of trade remedies for manufacturing industries; surveying and assessing the knowledge, capacity to initiate lawsuits, and capacity to appeal against trade remedies of priority industries.

Thirdly, performing the institution on trade remedies, accordingly, the project on Improving the capacity and effectiveness of trade remedies in the context of Vietnam's participation in new generation FTAs, Project on Strengthening coordination mechanism between agencies and organizations in handling trade remedy cases will be developed and submitted to the Prime Minister for approval; promulgating a circular guiding the implementation of commitments on trade remedies in the EU-Vietnam Free Trade Agreement (EVFTA)

Fourthly, strengthening the enforcement of regulations on trade remedies, including, researching and integrating the content of trade remedies in the strategies and plans for the development of industries, especially priority industries; continuing implementing Decision 824/QD-TTg of the Prime Minister and Resolution No. 119/NQ-CP of the Government; increasing participation in and protecting the interests of enterprises in the investigation of trade remedies of other countries; studying and developing policies and plans to fight and retaliate against other countries (if necessary) in case countries apply trade remedies to Vietnam's exports; monitoring the progress of trade remedy investigations within the WTO framework

According to Decision No. 1347/QD-BCT, funds for the implementation of activities are deducted from the State budget allocated to the Ministry of Industry and Trade and other funding sources.

Decision 1347/QD-BCT takes effect from May 19, 2020.
