Steel Wire Garment Hangers - The U.S investigates anti-dumping and anti-subsidy measures

On January 18, 2012, the US Department of Commerce (DOC) officially initiated an anti-dumping and anti-subsidy investigation on steel wire garment hangers imported from Vietnam. Nam and anti-dumping investigation on steel coat hangers originating from Taiwan based on the previous complaint filed on December 29, 2011.
I. Relevant information:
1. Petitions: M&B Metal Products Company,Inc. (Leeds, AL); Innovative Fabrication LLC/Indy Hanger (Indianapolis, IN); and US Hanger Company, LLC (Gardena, CA)
2. Goods under Investigations: Steel Wire Garment Hangers under the following categories of the Harmonized Tariff Schedule of the United States: HTSUS 7323.99.9060, 7323.99.9080, and 7326.20.0020
3. Investigation on dumping and subsidies by DOC:
* Dumping investigation:
On July 27, 2012, the US Department of Commerce issued a preliminary conclusion confirming price dumping on steel coat hangers imported from Vietnam.
On December 24, 2012, DOC issued a final conclusion confirming price dumping on steel coat hangers imported from Vietnam.

On May 30, 2012, DOC made preliminary conclusions confirming that there is a subsidy for steel coat hangers imported from Vietnam.
On December 24, 2012, DOC made the final conclusion confirming that there is a subsidy for steel coat hangers imported from Vietnam.

4. ITC damage investigation:
On February 10, 2012, the US International Trade Commission (ITC) made preliminary conclusions confirming that there was significant damage to the US domestic steel coat hanger manufacturing industry due to dumped and subsidized steel coat hangers imported from Vietnam.
On February 1, 2013, ITC issued a final conclusion confirming that there was significant damage to the US domestic industry due to subsidized and dumped Vietnamese steel coat hangers.
5. Official decision:
Based on the results of the DOC's dumping and subsidy investigation and the ITC's injury investigation results, the US Department of Commerce decided to impose anti-dumping and subsidy duties on imported steel coat hangers. imports from Vietnam with an anti-dumping duty equal to the final dumping margin (above) and an anti-subsidy tax equal to the final subsidy margin (above).
The order imposing anti-dumping and anti-subsidy duties both took effect from February 5, 2013.
6. Sunset reviews
* 1st sunset review
On October 26, 2017, the US Department of Commerce (DOC) announced the initiation of the 1st sunset review.
On March 5, 2018, the US Department of Commerce (DOC) issued the final results of the first sunset review of the order to impose an anti-subsidy tax on steel coat hangers imported from Vietnam. In this conclusion, DOC confirmed that the subsidy margin of steel coat hangers imported from Vietnam is 31.58% (except for one company with a separate subsidy of 90.42%). On the same day, the US Department of Commerce (DOC) issued the final conclusion of the first sunset review of the order to impose anti-dumping duties on steel coat hangers imported from Vietnam. In this conclusion, DOC confirmed that the dumping margin of steel coat hangers imported from Vietnam was 220.68%.
On May 23, 2018, DOC issued a decision to extend anti-dumping measures for another 5 years for steel coat hangers imported from Vietnam. Then, on August 14, 2018, the DOC also made a similar decision with the anti-subsidy measure.
* Second sunset review:
On April 3, 2023, the US Department of Commerce (DOC) announced the initiation of the second sunset review.
On July 3, 2023, the US Department of Commerce (DOC) issued the final results of the second sunset review of the order to impose an anti-subsidy tax on steel coat hangers imported from Vietnam. At this conclusion, DOC confirmed that the subsidy margin of steel coat hangers imported from Vietnam is 31.58% (except for one company with a separate subsidy of 90.42%).
On August 1, 2023, the US Department of Commerce (DOC) issued the final conclusion of the second sunset review of the order to impose anti-dumping duties on steel coat hangers imported from Vietnam. At the notice of October 04, 2023, DOC affirmed that the dumping margin of steel coat hangers imported from Vietnam is 220.63% and continues to impose an anti-dumping tax equal to this dumping margin (except CTN Limited Company, Ju Fu Co., Ltd, Triloan Hangers, Inc. are subject to a separate tax rate of 157%).
