Introduction on Trade Remedies Council

Trade remedies Council (hereinafter referred to as “the Council”) is an advisory body of VCCI, set up by the Decision of the President of VCCI.
The Council works for the interests of Vietnamese business associations and community in issues relating to trade remedies (including Anti-dumping, Anti-subsidy and Safeguard measures).
Members of the Council are individuals who have deep professional knowledge and practical experience of trade remedies, accept the invitation of VCCI President to join the Council.
 

The functions of the Council will be as follows:

i. Consulting, supporting business associations and community in trade remedy issues (including Anti-dumping, Anti-subsidy and Safeguard measures) against Vietnamese exports to other countries or against imports into Vietnam as well as other related issues;

ii. Carrying out or guiding the activities to raise awareness, improve skills of action or reaction for Vietnamese business associations and community in trade remedy issues.

 

The tasks of the council will be as follows:

i. Giving advice on manner and direction and assist Vietnamese business associations and groups of companies in preparing preventative measures, dealing effectively with trade remedy cases abroad against Vietnamese exports to minimize the loss;

ii. Giving advice on manner and direction and assist Vietnamese business associations and groups of companies in deploying measures to apply for the application of anti-dumping, anti-subsidy and safeguard measures against imports into Vietnam in accordance with related Vietnamese regulations and laws;

iii. Providing information, disseminating and training laws and practices on trade remedies for business associations and community to have better understanding of the nature and impacts of anti-dumping, anti- subsidy and safeguard measures in international trade;

iv. Training and improving necessary skills to deal with trade remedy claim from the point of view of the complainant and the respondent, so that business associations and community are well-prepared to be ready and active in trade remedy cases (if any);

v. Taking part in trade delegations if requested by the Government or consulting, commenting and providing information for government agencies in trade negotiations relating to rules and practices on anti-dumping, anti-subsidy and safeguard measures and in building related legal documents to make them reasonable, feasible and in line with rights and interests of Vietnamese business associations and community;

vi. Providing consultations, comments, information and other supports for government agencies in WTO dispute settlement procedures relating to anti-dumping, anti-subsidy and safeguard measures that Vietnam may take part in;

vii. Conducting researchs, surveys and other activities relating to trade remedy issues in Vietnam and worldwide;

viii. Taking part in domestic and international seminars, conferences on issues relating to anti-dumping, anti-subsidy and safeguard measures;

ix. Providing consultations and information for VCCI about issues relating to anti-dumping, anti-subsidy and safeguard measures.

 

Technical Assistant Panel

Technical Assistant Panel (TAP) is a assistant body for and under the Council, members of the Panel are specialists who have knowledge, skills and professional experience on trade remedies issues.

The Technical Assistant Panel can assist the Council by:

i. Conducting detailed analysis on relevant context, information and possibilities in order to make recommendations to the Council so that the latter can give proper advice on case-by-case issue.

ii. Assisting the Council in monitoring and supporting business associations and community during the implementation of its advice by the latter;

iii. Assisting the Council in discharging its functions and tasks.
